Peter is absolutely correct. Record Offices don't own the copyright to the Tithe maps. The maps were created so long ago any copyright ownership is irrelevant under current legislation.
They may either control the right of access (and hence can require a reproduction fee), or if you are not looking at the original map ie they have photographed or scanned them, they have created a new image and hence have copyright on that image (but not the orginal map).
