You also seem to misunderstand the use of predetermination (which is why I am asking for a DBA as a phase one) ... curatorial function and purpose.
Frankly I would have grave concerns at your attitude to archaeology.
A DBA is part of a Programme of Works.. ensuring that all known sources are consulted prior to you sticking your little trowel in the ground... and ensuring that you put your trowel in the right place... if you now in advance where existing archaeology is... or where that oil tank is that would remove archaeology.. would be advantageous... to both the developer and the curator... if you don't feel that it helps you ... or you feel it is funny to see if we know everything... then fine... you are promoting poor practice, subterfuge, and are nothing more than a puppet.
You... (the contractor).... does a dba, which will ensure you will put your trenches.. if required in the right place.... because I (the curator) can't know everything... and need help to ensure the best job is done and the correct conditions are added by the planner.... perhaps you were unaware that we (the DC archaeologists) don't put conditions on... we advise the planners... and that is based on available info.... withold it... and bingo... you have personally screwed it up.....

So you advise them to hide archaeology... and only get money if the curator can find the info that you have... but withold deliderately.... sick!
