Could any of you out there tell me what the basic or minimum legal provisions are under Health and Safety for welfare on sites?
I've just been informed about a situation that has occurred and before I comment I'd like to know the answer(s) to the above question. I think I know what they are but would like some confirmation if possible.

The situation is not cut and dried and there could however be problems as outlined in this section of the document:

Where the Construction (Design and Management)
Regulations 1994 [u]apply</u>, welfare provision needs to be
considered in both the pre-tender and construction
phase health and safety plans.

A number of interpretations have suggested that CDM Regs do not apply to archaeologists unless they are working on a site where the Regs apply to other workers.

Further the regulations [u]only</u> apply when a minimum number of staff are employed and for a minimum period of time. And then as it says these are recommended good practice and not compulsory.

I would suggest that the workers on the site that Ken is concerned about take the following actions:

• Talk to your co-workers about the situation
• Talk to your trade union
• Talk to your management

Good points Kevin, this situation does and has happened. Its often a case of the employer not willing to spend a small amount in my experience...shocking but true !!

You've forgotten the other old favourite - that CDM doesn't apply to archaeology because it doesn't fall under the definition of "construction work" used in the Regs.

CDM applies if the 'construction' phase is likely to involve more than 30 days or 500 person days of construction work. Numbers of personnel and the length of the project are irrelevant. (CDM 2007, Interpretation, Section 2-(3))

Anyhow, these 'minimum standards' and 'recommendations' should really be adopted as best practice by everyone. The fact that we've all spent time eating our lunch in a cr*ppy site hut and that it's possible to avoid providing appropriate facilities is no excuse.

Even the Deathstar provides an adequate supply of wholesome drinking water for its crew.

if you look at the top of each thread, you'll see there's a title. We call this the 'topic'. The original poster ('OP') invites people to write things about that 'topic'.
