Legal question of Jobs Adverts - BAJR Host - 3rd April 2008

BAJR has the following
http://www.bajr.org/terms.asp

what would you do if you found someone copying adverts, removing any link to BAJR and then selling, what on BAJR is free to view, the adverts to subscribers..? :face-huh:
How illegal is it, and should I take action should I discover it happening?

I would suggest that was illegal exemplified that peoples are paying for the adverts, that they are posted under good faith, that you are going to the effort to maintain and update your site, that you do not charge to view and and it is your business, income and copy righted material. There might be a problem with the country in which the material is stored or maintained. Tricky business though.

I might also condsider putting adverts and links in order to thwart their attempts.

Fire a shot across their ISP's bows! If they have one...

Are they based in the UK or EU?

You should be covered by copyright laws. ADS might be a worthwhile point of contact as I have previously recieved info (which I cant locate!) on internet copyright (which are quite substantial being a relativey new media). Then go get them.

I guess it was not so much the fact they used the adverts without permission, and stripped out the link to BAJR, but just the part about them charging for access to adverts that were actually free... seems that I am not the only one to have adverts harvested.. Will see what they say. ...

I checked some other job sites..

It seems that it is illegal to take jobs from websites, newspapers etc... without prior written permission .. let alone sell the adverts without even placing a link back to the original advertiser.

It does seem quite serious.. they have now removed my adverts.. but this has been going on for some time... and people are even informed that the ??service?? is copyright .. ??

Ya gotta laugh.

In my case, even though they have now removed my adverts ?V and I did point out that an RSS feed is available for people to legally add my adverts to a website were people can view them for free, they have yet to give any form of apology, and seem to think I am being unreasonable. Do you feel it is too harsh to

a) contact other job sites and see how they feel about advert harvesting?
b) That I would have a case for theft?

Not sure if it is legally defined as theft rather than copy write breach. You are probably within your rights to require certain things (such as a formal posted appology on their site) as a requirement of your generous goodwill(over this misunderstanding of the law)and in lieu of further legal action. Sounds like they are either full of it or just plan ignorant..

Sounds like they are scammers to me. I'd go at them as hard as possible, preferably in concert with anyone else who's being scammed.

If they don't make an apology then publish an anti-advert on Bajr, CBA site, IFA site etc warning people of their malignant activities

I have not posted for a good while but find this thread so funny that I just have to add something..... An encore I guess?!?

I organise projects which have had details #8216;harvested#8217; and added to a website. Previously information may have been sent out to them, but updated/new details (which are not 100% correct #8211; so it is obvious they have been collected without full investigation) have been taken with no contact being made. Images have also been reproduced without permission. The #8216;harvesting#8217; process has stripped out very important details regarding the operation which is hosting these projects. These details have been #8216;harvested#8217; from a site which has a clear copyright notice on every single page.

This #8216;harvesting#8217; website is also used to sell for personal profit and advertises all sorts of other things. So it helps them to have more projects listed#8230;.

I have no interest in an apology etc, in the end it helps the project, but it would be nice to be contacted first or at least #8216;harvest#8217; the right information.

(Why not just have a code that people have to use when applying for BAJR advertised jobs (eg http://www.bajr.co.uk-144156) or have the contact details available to when a code is entered?)
