Draft Heritage Protection Bill has been published today on the DCMS website and can be viewed on their website:

Minister Andy Burnham says:
"Heritage protection is as important as anything else we do in this Department. But nobody can sit in an office in London and decide what is heritage or not. Local communities have strong feelings about their own heritage and it is important that those voices are heard. "By unifying the protection regimes, encouraging wider participation, and making the system more transparent we aim to make heritage protection easier to understand and manage, and help it become an integral part of public life.

"The draft Bill we are publishing today follows long and extensive consultation. It reflects Government policy as expressed in last year's White Paper, and the consensus reached on that. But it is not the last word, because consultation goes on. That's why we're publishing it in draft. "We welcome the widest possible debate and, if there are proposals for further changes, we will consider them carefully in the light of all the views expressed. I am grateful for the time and trouble that so many organisations and individuals have taken getting us to this point."

Well one of the boroughs I deal with is effectively looking for a sop to pass onto a small town which is likely to be very 'regererated' over the next few years. There is great public pressure for a central conservation area, but the borough is unwilling to provide this as it would put in that bit more work for applications - it is that kind of place.

They have been looking to locally list buildings as a way of offering something to the lovely general public which will not have the effect of a conservation area. In the previous (was it a green paper?) paper there were references to applying article 4 directions to local lists. I am just wondering if this made it into the bill.

Have you tried the powers that county councils also have to declare conservation areas?

I'm fairly certain that all that would be required for making demolition and partial demolition development and therefore under the control of Article 4 directions would not require a new government act and all it would take is yet another amendment of the GPDO.

I recall seeing something about local lists in the section on HERs- once I get to that part of the document again I'll post in more detail.

Para 212 states that local lists must be in the HER. 215 seems to state that LPAs must have a published criteria of local listing.

I imagine that once the HPA is passed and enacted, the GPDO will be amended to provide protection of assets on the local list.
