the point is that if you know you are going to find a stiff, you as a professional with standards, should get a licence moreno

if you are going to uncover a body you should also tell the local coroner and the environmental health department - both of whom can shut you down if they think you are being irresponsible.

accidentlaly coming across stiffs is a totally different kettle of fish

If you are excavating a clearance cairn with the intention of proving that it is not a burial mound then surely you are acknowledging that there is a possibility, no matter how small, that there could be a burial present. Therefore encountering human remains is not out of the question so it would be responsible to have a license before commencing excavation.
